1. Using Toksyto
Who May Use Our Services
Use or access by anyone under 13 years of age is strictly prohibited. You may use our Services only if you can form a binding contract with Toksyto, comply with these Terms and all applicable Policies (including our Acceptable Use Policy and Honor Code), and are over the age at which you may consent to data processing under the laws of your country. Certain regions and course offerings may carry additional or different age restrictions.
Any violation of these Terms, applicable laws, or our Policies may result in your access being suspended, disabled, or terminated. When creating your Toksyto account, you must provide accurate and complete information and keep it up to date.
Our License to You
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to use our Services for personal, non-commercial purposes. You may create and use only one account, and you must not share your account or login details with anyone else. Using our Services does not give you ownership of, or intellectual property rights in, our Services or the content you access.
Commercial Use
Commercial use of our Services is strictly prohibited unless covered by a separate agreement with Toksyto. Organisations already using our Services are governed by separate terms.
2. Content Offerings
Toksyto offers courses and content ("Content Offerings") from various providers ("Content Providers"). We reserve the right to cancel, interrupt, reschedule, or modify any Content Offering, or change the weight of any assignment or assessment. Content Offerings are subject to the Disclaimers and Limitation of Liability sections below.
Toksyto does not grant academic credit for completing Content Offerings. Unless explicitly stated by a credit-granting institution, no academic credit is implied, and there is no guarantee that other institutions will recognise any credit awarded.
3. Your Content
Our Services let you share content such as assignments, projects, and forum posts ("User Content"). You retain all intellectual property rights in your User Content and are responsible for it. This does not include course materials provided by Content Providers or their instructors.
By sharing User Content, you grant Toksyto a fully-transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide licence to copy, distribute, modify, create derivative works from, and otherwise use it — including authorising Content Providers to use it with their own students or learners. We may remove or modify User Content that we believe violates these Terms or our Policies.
By submitting feedback, suggestions, or ideas about our Services, you grant us the right to use that feedback without restriction or compensation to you.
4. Security
We work to protect the security of your account, but we cannot guarantee that unauthorised third parties will never defeat our security measures. Please notify us immediately of any compromise or unauthorised use of your account at info@dhanak.world.
5. Third Party Content
Through our Services you may access content or links provided by instructors, other users, or third parties. We cannot guarantee that such content will be free of material you may find objectionable, or of malware or other harmful elements. Toksyto disclaims responsibility for your access to, or use of, any third-party content.
6. Copyright and Trademark
Toksyto respects the intellectual property rights of our users, Content Providers, and other third parties, and expects users to do the same when using our Services.
7. Education Research
Records of your participation in courses may be used for education research. You may be exposed to variations in Content Offerings as part of this research. Findings are typically reported at an aggregate level, and your personal identity will not be publicly disclosed without your express consent.
8. Paid Services
Toksyto offers certain paid Services (such as course certificates) for a fee, quoted in INR unless otherwise stated. You're responsible for paying all applicable fees and taxes on time. Fees may vary by location and may change at our discretion, effective immediately upon posting. Refunds, where available, are described in our Cancellation & Refunds policy.
9. Modifying or Terminating Our Services
We may add, remove, or change features of our Services, or suspend or stop part of them altogether, and may terminate your use of any Service for any reason. If a paid Service is terminated, a refund may be available under our Refund Policy. We may be unable to deliver Services in certain regions due to access limitations or government restrictions, and Toksyto shall have no liability for such actions. You may stop using our Services at any time.
10. Disclaimers
To the maximum extent permitted by law, our Services and all included content are provided on an "as is" basis without warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Any access to or use of the Services is at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Toksyto shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or goodwill arising from your access to or use of the Services, the conduct of any third party, or unauthorised access to your content. Our aggregate liability for all claims related to the Services shall not exceed INR 10,000, or the total fees you paid us for paid Services during the past month, whichever is greater.
Any cause of action related to the Services must be brought within six (6) months after it accrues, or it will be permanently barred.
12. Indemnification
You agree to indemnify, defend, and hold harmless Toksyto from claims, liabilities, expenses, and damages — including reasonable attorneys' fees — arising from your misuse of the Services in violation of these Terms, your violation of any law or third-party rights, or your User Content.
13. Governing Law and Venue
Toksyto is managed from Mumbai, Maharashtra, India, and these Terms are governed by the laws of India.
14. General Terms
We may revise these Terms at our discretion; revisions take effect immediately upon posting. For material changes, we'll take reasonable steps to notify you via a website banner, email, or another method. Continued use of the Services after such changes constitutes your acceptance of the revised Terms. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to act on any non-compliance does not waive our right to act in the future. Our Content Providers and integrated service providers are third-party beneficiaries of these Terms and may enforce the provisions relating to them.
Acceptable Use Policy
Toksyto aims to provide broad access to practical education while preserving free expression and academic freedom, and keeping our community safe and comfortable. We may remove or edit content or activity that violates this policy, and may suspend, disable, or terminate a user's access accordingly.
You may not share content that:
- Contains illegal content, or promotes illegal activity with intent to commit it — bearing in mind that users as young as 13 use Toksyto;
- Contains credible threats or organises real-world violence, or creates a genuine risk of physical injury or property damage;
- Harasses others or is abusive toward private individuals;
- Violates intellectual property, privacy, or other rights — always attribute material you use or quote to its original owner;
- Spams others with irrelevant advertising or solicitation; or
- Otherwise violates the Toksyto Terms of Use.
Specific Content Offerings may carry additional rules and requirements.
You also may not:
- Violate any law, contractual obligation, or fiduciary duty;
- Share your password or let anyone else access your account, or attempt to access another user's account;
- Reproduce, transfer, sell, or misuse content from our Services without authorisation;
- Access or tamper with non-public areas of our systems, or attempt to break or circumvent our security measures;
- Attempt to reverse-engineer any part of our Services;
- Interfere with any user, host, or network — for example via viruses, spam, or overloading;
- Distribute malware through our Services;
- Use our Services for anything other than completing courses or pedagogical purposes;
- Impersonate or misrepresent your affiliation with any person or entity; or
- Encourage or help anyone do any of the above.
Without our prior written consent, you also may not:
- Use manual, mechanical, or automated means (including bots) to scrape or harvest content, data, or text from our Services; or
- Use any content, data, or text from our Services for text or data mining, or to develop or train any application, software, or model — including generative AI or other machine-learning models — for commercial or non-commercial purposes.
